We believe that regulatory compliance is of utmost importance. Our firm is built on a culture of compliance. NCS Regulatory Compliance has been our compliance consultant for over 8 years. NCS Regulatory Compliance has been a very good partner. Everyone we have dealt with at NCS Regulatory Compliance is knowledgeable and professional, especially Mr. Alan Foxman. NCS Regulatory Compliance helps us with all of our annual regulatory filing requirements at both the FINRA and state levels.
Three years ago, NCS Regulatory Compliance helped us with the very complex registration requirements for a new credit union client. The credit union relationship has been very important to our firm and we could not have initiated the relationship without the help and guidance from NCS Regulatory Compliance.

We would give ZERO stars if we could. Much more to come. Everything posted is either Fact or Opinion. Douglas Kamin, : Sat in our office on January 22, 2015 and stated that one of his objectives as an Independent Compliance Consultant was to train our staff on how to be a "Whistleblower" for the SEC. Our corporate attorney was present at the meeting.
We believe advisors have enough to worry about than to have an ICC turning their employees into spies. Soon after this meeting Mr. Kamin joined NCS as a "Senior Consultant". We were also very disappointed that NCS was unable to provide a monthly invoice in the pre-agreed to format. Our agreement stated we would get a monthly invoice that showed the "actual vs. estimate" regarding all the work that that was preformed on our account.
Each entry was to include a detailed explanation of the exact work that was done. We never once received an invoice that meet this criteria. The invoices were very vague and in our opinion looked to be made up on the spot. Next up Mr Mark Alcaide: On a call with us he said that he viewed his role as "an extension of the SEC". When we reminded him he was "our hired consultant" he didn't agree.
We then contacted the SEC about his statement and they didn't agree with him. Our CCO (who was on the call) said we should have fired NCS Regulatory Compliance on the spot. On another occasion Mr. Alcaide in an email, that we still have, assured us that "under no circumstances would NCS Regulatory Compliance contact any non XXX employee". Not longer after receiving that assurance NCS Regulatory Compliance did that exact thing.
They were even stupid enough to put that contact in writing. Which of course we still have. In my world that is at the very least a blatant lie and possibly grounds for a breach of contract law suit. Which we are still considering. If you are looking for an independent compliance consultant to be a strategic partner who doesn't lie and had your back NCS Regulatory Compliance in my opinion is NOT a good choice. Beware.
Mr James Hardaway: In our opinion he totally misrepresented his knowledge in the area of compliance we was being vetted to preform. In fact We think that goes for the entire firm. We have an email from James to Les Abromovitz asking for help on the assignment. Mr Abromovitz's response was very alarming. He told Jame's that he was under the impression that NCS did not take our work because he didn't feel the firm (NCS) had the ability to to do what was requires.
In fact, he said he told NCS NOT to take the job. Who is Mr. Abromovitz? He is just NCS's senior consultant. Here is his bio copied directly from their website: Senior Consultant Les Abromovitz serves as a senior consultant with NCS Regulatory Compliance. He has handled publishing and compliance consulting projects for the firm since 2003. Les is responsible for conducting compliance reviews of web sites, marketing materials, social media communications, presentations, brochures, books, blogs, newsletters, proposals, radio programs, commercials, YouTube videos, and performance reports, as well as performance advertising.
In addition, Les is a contributor to the NCS Regulatory Compliance monthly compliance newsletter. Les is the author of two books on compliance for investment advisers, which were published by National Underwriter/Summit Business Media. Les is a member of the Pennsylvania bar. Although we feel that Mr. Abromovitz seems to be an extremely knowledgeable and experienced individual why did NCS ignore is recommendation when it came to our project.
Why did James state to us, our attorneys and most likely the SEC that we was up to the tack. When he clearly wasn't. It seems that James & NCS said what ever there had to to get the job. In reviewing NCS's website we can't find any mention of James. Did NCS fire him? Why did James remove mention of NCS from his LinkedIn page and bio? We can only guess. The bottom line Mr. Hardaway is in our opinion is a liar and can't be trusted. We found Mr Ken Kaltman to be little help.
